Terms and Conditions of Service

By submitting an order to Y-Transport, the client agrees to abide by these terms and Y-Transport reserves the right to amend or modify these terms without prior notice.

General Provisions

Unless otherwise agreed in writing, all services provided by Y-Transport will adhere to the following terms and conditions, which take precedence over any conflicting terms of the client or third parties. Should any clause in these terms be deemed invalid, illegal, or unenforceable under current law, it will be considered null and void, without affecting the validity of the remaining provisions. In instances not covered by these terms, the relevant industry logistics conditions will apply. By submitting an order to Y-Transport, the client agrees to abide by these terms. Y-Transport reserves the right to amend or modify these terms without prior notice.

Order Placement

All orders must be made in writing. Orders placed by phone are only considered final once they are confirmed in writing by the client.

Client Responsibilities

The client is responsible for providing accurate and complete information. Y-Transport operates on the assumption that all provided details are correct and complete, and does not independently verify their accuracy. Additionally, the client is responsible for fulfilling all customs requirements and ensuring the timely submission of any required documentation to Y-Transport at the time of pick-up. If Y-Transport is requested to handle customs procedures, the client must provide the necessary documents and assume all associated risks and costs.

Transportation Services

For transport services, the client must submit all necessary details, including the pick-up and delivery locations, dimensions, weight, descriptions of the goods, and any special requirements. These details must be provided by 10 a.m. on the workday prior to pick-up. The client guarantees that the pick-up and delivery locations are accessible and that all goods are properly packed and ready for transport. If air freight services are requested, a Dangerous Goods Declaration must be provided if applicable. All transport times are estimates, and Y-Transport will make reasonable efforts to meet these timelines. Transportation will generally take place between 8 a.m. and 5 p.m. on business days. An additional surcharge will apply for expedited shipments.

Liability and Responsibility

Y-Transport’s liability is governed by the applicable transport conventions, including the CMR Convention for road transport and relevant international air transport agreements for air freight. Y-Transport is not liable for any indirect or consequential damages. The liability for damages to goods is capped at €25,000 per occurrence, with an annual aggregate limit of €75,000.

Rates and Payment Terms

Rates are quoted in Euro (€) and exclude VAT, tolls, and other applicable taxes unless otherwise specified. Rates are subject to change based on fluctuations in fuel prices, taxes, or other relevant costs. Payment is due as per the terms stated on the invoice, with late payments subject to interest and additional charges. If an order is canceled or only partially loaded, Y-Transport reserves the right to apply a cancellation fee, and the client agrees to cover any extra charges incurred.

Claims and Disputes

Any claims regarding services must be submitted to Y-Transport within 7 days of receiving the invoice. Failure to report within this time frame will result in the claim being void.

Miscellaneous

Y-Transport reserves the right to enforce the terms and conditions of this agreement strictly. A failure to do so does not waive any of its rights. The exclusive jurisdiction for any disputes arising from this agreement is with the Commercial Courts and Belgian law will apply.
